It is our policy at Terminal Resource, lc. (TR) to provide you with the highest level of privacy & security possible. We never use or share the personally identifiable information provided to us online in ways unrelated to the TR-related services without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.
Not all fees listed on fee schedule apply to any single merchant. Point-of-sale terminals are available at discounted rates from TR. Non-Qualified rate may apply to Business, Corporate, International, Purchasing Cards, Commercial Cards, Rewards Cards, MasterCard World Cards, and Travel & Entertainment Cards. Rate may also apply to transactions not batched within two days or transactions made without Address Verification (AVS). Separate approval required and fees may vary for American Express and Discover. Please contact TR for the most current pricing on these programs.
Account verification fee will be charged at the time of your merchant account activation as a means of verifying the bank account information you enter on the online application. All rates subject to change. Current fees will be listed on your merchant application when you activate. Please read through the terms and conditions and contact TR with any questions or concerns before signing.
All card processors are required to comply with the Visa and MasterCard Association rules and regulations. As such, there are certain items that you, the merchant, should be aware of before applying for a merchant account.
In some instances, merchants may be required to hold more than one merchant account. These circumstances might include: Merchants selling products spanning more than one category. Merchants who sell products in more than one merchant category code are required to have more than one merchant account; Merchants operating under different business names; Merchants that sell a website to another business. Contact your reseller for details regarding multiple merchant accounts.
Product/Pricing Conformity: The products and pricing listed on your website must conform to the products and pricing you list on your merchant application.
To prevent unauthorized access, maintain data accuracy and ensure the correct use of information, we have put in place appropriate physical, electronic and managerial procedures to safeguard and secure the information we collect online. TR will provide login and password information intended for use by the Client only. It is the sole responsibility of the Client to maintain the security of their login and password information. Login and password information is meant for use by Client only and may not be transferred or made available to any third party.
Client has the full responsibility to provide current or updated contact information to TR, including physical address, telephone and fax numbers, and email address changes.
TR provides services to individuals 18 years of age or older. We do not knowingly collect or maintain information at our website from those we actually know are under 18, and no part of our website is structured to attract anyone under 18.
TR's liability is limited to amounts paid to it. Neither Client nor TR will be liable, except for any obligation to pay money.. It is the obligation of the Client (applicant, account holder, etc…) to contact TR regarding customer service issues, complaints, or concerns. The Client assumes full responsibility and liability for any damages, financial or otherwise, relating to his or her business. TR does not guarantee acceptance or approval of all Client applications. All applicants are required to disclose all pertinent and meaningful information in regards to financial history, credit worthiness, and ability to fulfill financial and business obligations. It is the understanding of the Client that TR, it's officers, agents, affiliates, shareholders, or employees will not be held liable, for any direct, indirect, incidental, consequential, or exemplary damages from the use of any products or services provided by TR.
TR has absolute discretion to refuse to provide services to Clients who cannot or will not meet certain criteria required for application processing and approval. TR provides a means in which to process credit card transactions. TR makes no endorsement of, is not liable for, and cannot be held responsible for the validity of Client product or services offerings, fulfillment, or guarantees. These terms may be modified at any time without notice.
Binding Arbitration: Consent to binding arbitration before the American Arbitration Association: by execution of your transaction of application both parties consent and agree that any and all disputes that arise between them concerning the transaction or any of the terms of the agreement, or that concern any aspect of the relationship between client and TR, shall be decided exclusively in binding arbitration conducted by the American Arbitration Association ("AAA"). Client and TR further consent and agree that any and all AAA arbitration hearings shall be conducted in Orem, Utah, where TR is headquartered and located, before a single AAA arbitrator. Both parties agree that a complaint may be filled with the AAA office in any state. The arbitrator shall be appointed in accordance with section R-13, appointment from panel, of AAA's commercial arbitration rules. Client and TR consent and agree that the AAA arbitrator shall exclusively apply Utah law to the dispute, regardless of and without giving any consideration of choice of law principles. Client and TR further consent and agree that each party will bear his/her/its own cost and attorneys' fees incurred in connection with the AAA arbitration proceedings, and agree that the AAA arbitrator shall have no power or discretion to make any award of cost or attorneys' fees. In the event that client or TR files any court proceedings in violation of the contractually agreed upon arbitration requirement, the party who is required to appear in any court proceedings to defend against such proceeding shall be entitled to an immediate stay and dismissal of such court proceedings, and shall be entitled to an award of all reasonable attorneys' fees and costs incurred in connection with such court proceedings. The final decision of the arbitrator shall be furnished in writing and shall constitute a conclusive determination of the issue in question, binding upon the client and TR, and shall not be contested by either of them, except as permitted by applicable law. Such decision may be used in a court of law only for the purpose of seeking enforcement of the arbitrators' award.
Prohibited Merchant Types: The following merchant types are prohibited and will not be approved for a merchant account through Terminal Resource: Adult Materials, Airlines, Business Opportunity (Get Rich Quick Schemes), Buying/Shopping Clubs, Check Cashing Services, Collection Agencies (If Written off Debt) Credit Repair/Restoration, Cruise Lines, Direct Inbound Telemarketing, Direct Outbound Telemarketing, Escort Services, Gambling, Gaming - Car, Horse, and Dog racing Hair Restoration (e.g. Rogain), Investment Opportunities, Lottery/Raffles, Online Dating, Prescription Drugs, Pornographic Materials, Products with unreasonable guarantees MLM Opportunities, Time Shares, Tobacco Products (through MOTO/Internet), Travel Agencies, Tour Operators, Travel Clubs (fees over
