PREAMBLE

In the name of the Beneficent God of All, we who have honorably served and or are now serving in the United States Marine Corps, for the common good of this Nation, and for all the nations and peoples in this world, and in order that the fundamental rights of every person may be preserved, to foster interest in the affairs of the United States Marine Corps to promote and advance the welfare of wounded and disabled Marines, FMF Corpsmen, FMF Chaplains and their dependents and for further purposes as set forth herein, do solemnly and firmly associate ourselves in a nonprofit corporation known as the Pahrump Detachment #1199 Marine Corps League Incorporated and established by these Bylaws.

ARTICLE I

SECTION I: The name of this organization shall be the Pahrump Detachment, #1199 of the Department of Nevada Marine Corps League.

SECTION II:The corporation seal shall be round in shape, containing in the center thereof, a replica of the United States Marine Corps emblem, surrounded by the words, “Pahrump Detachment #1199”, “Marine Corps League”, with a border of two (2) narrow rings, with a star centered between the words “Marine” and “Pahrump” and “#1199” and “League”.

SECTION III: The corporation seal shall remain in the custody of the Commandant at all times.

ARTICLE II

SECTION I: The purposes for which this Detachment was formed are:

  1. To preserve the traditions and promote interests of the United States Marine Corps.

  2. To band together those who are now serving in the United States Marine Corps, including FMF Corpsmen, FMF Chaplains and those who have been honorably discharged, or have received a General Discharge under Honorable conditions, from the United States Marine Corps, also to include FMF Corpsmen and FMF Chaplains in fellowship that they may effectively promote the ideals of American Freedom and Democracy.

  3. To fit its members for duties of citizenship and to encourage them to serve ably as citizens as they have served the nation under arms.

  4. To foster love for the principles which they have supported by blood and valor since the founding of the Republic.

  5. To hold sacred the history, traditions. and memory of those who have given their lives for our Nation. f. To maintain true allegiance to American Institutions.

    f. To maintain true allegiance to American Institutions.
     g.  To voluntarily aid and render assistance to all Marines, Associate Members,   their families, widows and orphans. voluntarily aid and render assistance to all Marines, Associate Members, their families,   widows and orphans.

ARTICLE III MEMBERSHIP

Membership shall not be denied any applicant, otherwise qualified, on the basis of race, religion, sex, creed or National origin. Membership categories are: Regular, Associate, Honorary, Life and Dual. All requests for membership must be accompanied by a signed completed application with first year’s dues attached.

SECTION IREGULAR MEMBERSHIP Only persons who are serving or who have served honorably in the United States Marine Corps, “On Active Duty”, for not less than ninety (90) days and persons who are serving or who have served in the United States Marine Corps Reserve and have earned no less than ninety (90) days Reserve Retirement Credit Points and FMF Corpsmen who have trained with Marine FMF Units in excess of ninety (90) days and earned the Marine Corps Device (clasp) worn on the Service Ribbon and those who earn the Warfare device authorized for FMF Corpsmen shall be eligible for regular membership in the Marine Corps League.

HONORABLE SERVICE will be defined by the last DD 214 or Certificate of Discharge under Honorable conditions are eligible for regular membership.

SECTION II: Should a Member who is serving on Active Duty in the United States Marine Corps or the United States Marine Corps Reserve be discharged under other than honorable conditions their membership shall be immediately reported to Departmental Judge Advocate for official action.

SECTION III: An applicant for membership shall not be accepted for membership until his credentials have been inspected by the Detachment Commandant or his designated representative.

SECTION IV: No member shall be eligible for an elective or appointed office in the Detachment unless they are a member in “Good Standing”.

SECTION V: Membership year and annual dues shall expire on September 1st of each year.

SECTION VI: ASSOCIATE MEMBERSHIP Those individuals not qualified for regular membership in the Marine Corps League as contained in its Congressional Charter may upon application, be accepted for Associate Membership in the Marine Corps League. Associate members, upon acceptance, will pay dues in the same amounts as prescribed for regular members, including any initiation fees. A membership pin and membership card, indicating “Associate Member” will be issued by National Headquarters. The appropriate uniform and cover, including an ornamental device and lettering will be designated by the National Uniform Committee. An Associate Member shall be entitled to all rights, privileges and benefits of a regular member, excepting, such member shall not vote on a membership application, an election of officers or hold an elective office.

  1. Individuals who are serving or have served in other branches of the Armed Forces of the United States must have served honorably.

  2. Individuals applying for Associate Membership subsequent to August 11, 1995 must have reached a statutory minimum age for enlistment into the United States Marine Corps or United States Marine Corps Reserve prior to being enrolled as an Associate Member.

SECTION VII: NEW MEMBER PROGRAM: The new member introduction program is designed to welcome the new member to the Detachment and advise them of all current programs and activities that are on-going and repetitive. Each new member will be assigned to a Mentor to explain the routines of the Detachment and make the new member feel at home. 

  1. Commandant: Greet the new member; assign a mentor, conduct an interview, explain the structure of the Detachment and deliver a current copy of the Bylaws and a check-in sheet.
  2. Sergeant at Arms: Explain the layout of the meeting area, protocol of the meetings, and introduce the new member at the meeting. Ensure that a member’s badge is available at the first meeting.
  3. Historian: Arrange to take pictures and load to the members section of the social site. Copies of members picture provided at Detachment cost.
  4. Paymaster: Explain reimbursement procedures and ensure members application is submitted to National as quickly as possible.
  5. Quartermaster: Facilitate the supply of any uniform requirements of the new member.
  6. Junior Vice Commandant: Greet the new member and explain the importance of obtaining new members and solicit the new members assistance in recruiting other family members.
  7. Adjutant: ensure that all membership data is current and correct, add to email notification rolls if desired.
  8. Service Officer: Offer up-to-date veterans information, review disability status and assist with VA contacts and DAV contacts.
  9. Web Sergeant: Introduce the new member to mcl1199.org. Answer any Web related questions the new member may have.
  10. Senior Vice Commandant: Review and ensure timely completion of the check-in sheet. 
SECTION VIII: Membership dues shall be as follows:
  • Initial and combined dues for the first year shall be thirty-five dollars ($35.00). This sum shall be presented along with (DD 214) credentials. Each member shall purchase their cover. Embroidery of Detachment name and number costs shall be borne by the Detachment, other embroidery, such as office or Life shall be at the members expense.
  • Annual renewal dues of thirty-five dollars ($35.00) shall become due on or before 1 September of the current year.
  • Members of the United States Marine Corps while on Active Duty shall be exempt from from dues while on Active Duty. 
  • New members joining the Detachment between March 1st and June 1st shall pay prorated dues to National of twenty-five dollars ($25.00)                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                
SECTION IX: The amount of dues for membership will be determined by the membership. The dues for each member shall have been paid on or before September 1st of each year. All dues shall be paid to the Detachment Paymaster. A member will be considered delinquent and not in good standing for the last day of the month of September if their dues are not paid. A member not in good standing shall not enjoy any of the benefits according membership in the Marine Corps League. A member has one (1) year to "make up” their dues or they will be dropped from the rolls of the Marine Corps League. A member may reinstate his membership number by paying all past and current dues.



SECTION X: The Detachment may have an annual “Marine of the Year” Award and an annual “Associate Member of the Year” Award, these to be presented to the Regular Member and the Associate Member of the Detachment who has performed the most valuable service to the Detachment for the past year. That no member shall be awarded a second such award until a period of at least four (4) years since the previous award. Any member may nominate the “Marine of the Year” and “Associate Member of the Year” and submit their names to the detachment for a vote. The period of service will be from 1 April to 1 April and the award shall be a plaque, certificate, ribbon and medal for the “Marine of the Year” and a plaque, certificate, ribbon and medal for the “Associate Member of the Year”. 
                         ARTICLE IV - FUND RAISING
 
SECTION I: The Ancillary Committees shall make their own arrangements for fund raising in such a manner that it does not conflict with other Detachment activities. 
SECTION II: Fund raising by means of Social Affairs other than those operated by the Ancillary Committee shall be under the supervision of the Senior Vice Commandant and his Social Committee. Incoming Senior Vice Commandant will follow through with any arrangements made by the previous Senior Vice Commandant.
SECTION III: Not more than one (1) Demand account of this Detachment shall be kept in any one (1) bank.
SECTION IV: Checks drawn on funds for any purposes must be signed by two (2) signatories, either the Commandant or the Senior Vice Commandant and the Paymaster for the General Fund. 
SECTION V: All those authorized to sign or co-sign checks or those who handle Detachment Funds are bonded through National Headquarters

ARTICLE V - ADMINISTRATION
SECTION I:The administration shall conduct business and exercise the power an authority of this Detachment which shall be vested in the “Board of Trustees”. and the “Oversight Board”. 
SECTION II: The “Board of Trustees” shall consist of the Commandant, Senior Vice Commandant, Junior Vice Commandant, Judge Advocate and Junior Past Commandant. The “Oversight Board” are the appointed officers and shall consist of the Chaplain, Paymaster, Quartermaster, Adjutant, Sergeant at Arms, Service Officer and Historian.
SECTION III: Three (3) members of the “Board of Trustees” (also to be known as the Finance Committee) shall form a quorum for the purpose of conduction business but all members of the “Board of Trustees” must be notified of any meetings.
SECTION IV: They shall have the power to make decisions between regular meetings of the Detachment and such decisions shall be legal and binding on the Detachment. A record of every such meeting and decisions made must be reported at the next regular meeting of the Detachment and the written report be filed as part of the Detachment records.
ARTICLE VI - TRUSTEES
 
SECTION I: The administration shall conduct business and exercise the power an authority of this Detachment which shall be vested in the “Board of Trustees”. and the “Oversight Board”.
SECTION II: Three (3) members of the “Board of Trustees” (also to be known as the Finance Committee) shall form a quorum for the purpose of conduction business but all members of the “Board of Trustees” must be notified of any meetings.
SECTION IV: They shall have the power to make decisions between regular meetings of the Detachment and such decisions shall be legal and binding on the Detachment. A record of every such meeting and decisions made must be reported at the next regular meeting of the Detachment and the written report be filed as part of the Detachment records.

ARTICLE VII - MEETINGS

    SECTION I: Regular business meetings shall be held on the second Saturday of each month at 1000 hours at the designated place of assembly. Members present at a prior meeting may suspend, delay, change or cancel a meeting by vote for cause. A quorum of two (2) elected officers and five (5) members in good standing is required to conduct a business meeting.
    SECTION II: The Adjutant or his designated representative, shall publish a monthly notice of all events, (monthly Newsletter), that will include all meetings and special events scheduled for the Detachment. All members in good standing shall receive such notices. Materials, printing and mailing costs will be borne by the Detachment.
    SECTION III: The Commandant shall have the power to call special meetings when necessary. A written request from three (3) or more members in good standing shall be required to call any other special meetings. The Commandant shall call each Special Meeting within five (5) days unless a regular meeting comes before such date.
    SECTION IV: Robert’s “Revised Rules of Order” shall govern all meetings. Parliamentary procedure shall prevail at all meetings.
    SECTION V: The Commandant shall be addressed as “Commandant” or “Sir”. Regular members shall be addressed as “Marine” Last Name. Associates shall be addressed as “Associate” Last Name.
    SECTION VI: A member wishing to address the Chair or make a motion shall stand and when recognized state “Marine (state Name)” or “Associate (state Name).
    SECTION VII: No alcoholic beverages will be allowed in the meeting room, before and during any meeting, also the smoking lamp is out during the meeting.
    SECTION VIII: Members shall wear the authorized Marine Corps League cover to all meetings.
    SECTION IX: In compliance with the Marine Corps League Uniform Code, only the Marine Corps Emblem, office strips and those authorized the Devil Dog Patch may be worn on the Marine Corps League cover.
    SECTION X: Only officers holding office shall wear Office Identification Strips on their covers. Officer Identification may be embroidered in lieu of the strip. At the end of their tour of duty, officers shall remove the title strip. Past Commandants may wear the title “Past Commandant” with year mark.
    SECTION XI: All business meetings and ceremonies will be opened with the Pledge of Allegiance using the Marine Corps League Ritual Handbook as a guideline. In all other meetings the Pledge will be at the call of the meeting’s chairman.
    ARTICLE VIII - ELECTIONS AND INSTALLATIONS
    SECTION I: Pahrump Detachment #1199 shall nominate and elect its officers during the month of October and installation of such Officers shall take place at the Marine Corps Birthday Celebration. The Standard Report of Officers and Installations is to be forwarded to respective Department and National Headquarters not later than ten (10) calendar days after such installation. Should the detachment fail to file such report by 30 June they shall be declared in default and not in good standing.
    SECTION II: Entertainment and greeting of guests shall be the responsibility of the incumbent Commandant, but all expenses shall be borne by the Detachment.
    SECTION III: Nominations shall be in person and no second is required. No Marine may nominate more than one (1) person for any one (1) office, unless declined, but may nominate a member for each office. A person to be elected must be present in person and agree to the nomination.
    SECTION IV: When two (2) or more are nominated for the same position, elections shall be by official written ballot.
    SECTION V: Officers shall be elected in the following sequence: Commandant, Senior Vice Commandant, Junior Vice Commandant, Judge Advocate and Junior Past Commandant.
    SECTION VI: When all persons have been nominated for office, the Chairperson of the Election Committee shall call their names in reverse order to ascertain if they will accept the nomination or not. The Adjutant will certify that the candidates are eligible for election to office.
    SECTION VII: If nominated, the incumbent Commandant may be re-elected to additional terms.
    SECTION VIII: The newly elected Commandant shall appoint the following officers prior to installation: Chaplain, Paymaster, Quartermaster, Adjutant, Sergeant at Arms, Service Officer, Web Sergeant and or Historian.
    SECTION IX: The Commandant shall appoint by letter the Chairperson of Special Committee(s) as required during the year. Previous appointments may be extended verbally.
    SECTION X: The delegates to Conventions, Rallies, etc. shall be nominated at a regular business meeting prior to the event. The number of delegates eligible to attend shall be announced by the Convention Committee. The Delegate with the most votes shall be Chairperson.
    SECTION XI: The Detachment shall pay the registration fees of all Delegates who represent the Detachment at any Department or National Convention.

                              ARTICLE IX-DUTIES OF OFFICERS

    SECTION I: COMMANDANT: It shall be the duty on the Commandant to preside over all Board of Trustees, Special and General Membership Meetings. Observe and enforce the Constitution, Bylaws and Administrative Procedures of the Detachment, the Department of Nevada and National Marine Corps League Directives. Direct and/or delegate to all officers and members such orders for the good and welfare of the Detachment which are necessary for the proper conduct of business. Be a signatory on the Detachment’s checking account. Represent the Detachment at all social functions and ceremonies.
    Be an ex-officio at all official committees. Ultimately lead and guide the Detachment in the purposes described in Article II of these Bylaws.
    SECTION II: SENIOR VICE COMMANDANT: Will assume the position of the Commandant of the Commandant’s office is declared vacant by the Board of Trustees. Assume any and all duties normally assigned to the Commandant if the Commandant is not present. Perform such duties as may be assigned to him by the Commandant for the good order and welfare of the Detachment. He shall be assigned the duties as Chairperson of the Finance Committee and serve as the Professional Program Coordinator. Is an alternate signatory on the Detachment checking account. He shall prepare an annual budget for Community grants that is based on the previous fiscal year’s collections. He shall provide and publish to the membership guidelines for all grants and disbursements of the Finance Committee, no one activity may exceed ten percent (10%) of the annual budget and is subject to audit.
    SECTION III: JUNIOR VICE COMMANDANT: Shall preside in the absence of the Commandant and the Senior Vice Commandant, while so presiding shall have the power and authority of the Commandant. The Junior Vice Commandant shall preside as Chairman of the Finance Committee should the Senior Vice Commandant be absent and shall be the Chairperson of the Membership Committee of the detachment having the power to call upon Detachment members to assist in recruiting duties.
    SECTION IV: JUDGE ADVOCATE: Shall perform such legal duties as are assigned to him by the Commandant. He shall rule on any disputed point of order. He must be conversant with National, department and Detachment Bylaws. His opinions are binding but may be appealed.
    SECTION V: JUNIOR PAST COMMANDANT: Shall serve on the Finance Committee and have organizational cognizance over all Standing Committees. May be assigned as publisher and editor of the monthly Newsletter.
    SECTION VI: ADJUTANT: The Adjutant shall keep proper minutes of all meetings of the Detachment. He shall keep the Detachment Roster of members up to date as changes are reported by members and perform all duties as assigned by the Commandant. He shall be the Chairman of the Awards Committee.
    SECTION VII: PAYMASTER: He shall keep all monies, other than the special funds which are under control of special or standing committees. He shall submit his financial records for audit by the Board of Trustees, semi-annually during April and October of each year. He shall be responsible to keep true and accurate records of all funds received and disbursed on behalf of the Detachment. Arrange for deposits of all monies in a bank designated by the board. Funds collected shall be deposited to the Detachment’s account as soon as possible but in no event longer than five (5) bank business days.
    Pay all legitimate bills and debts for the normal upkeep and maintenance of the Detachment. Disbursements shall be made by check or debit card, the debit card may only be used personally by the Paymaster and only when a check is inappropriate as authorized herein. The Paymaster is authorized to send up to three hundred dollars ($300.00) without prior approval but must justify the expenditure to the board at the next meeting. Make monthly reports to the Detachment Membership on the financial position of the Detachment subject to audit. Provide reports, projections and financial recommendations to the board as required. Act as the liaison with the Department of Nevada and National as concerns membership and dues. He will submit any financial reports they require. He shall also make financial reports to the State and Federal Government as required. Bonding is automatically provided by the Marine Corps League. Be a signatory on the Detachment checking account. Make his books and records available at any time for a board authorized audit. At the conclusion of his term in office surrender all books, records, monies and any other property under the Paymaster’s charge to the newly appointed Paymaster (within 14 days max).
    SECTION VIII: CHAPLAIN: Shall perform such duties of a spiritual nature as customarily performed by members of the clergy within the guidelines of established Marine Corps League procedures. Assist members with sickness and condolence calls, correspondence with family members and their families. Advise the board and/or general membership of any Marine who are sick or distressed. Perform whatever rituals are required of his office at meetings, funerals and special functions as outlined in the Marine Corps League ritual handbook.
    SECTION IX: SERGEANT AT ARMS: Shall assist the Commandant in keeping order at all meetings. He shall act as Chairperson of the House Committee and see that all is in readiness for all meetings. He shall check the members present for eligibility and assure himself that only those entitled are admitted. He shall act as escort to all visitors and perform such duties as the Commandant may assign him. He shall be in charge of all Detachment property not in the possession of the Paymaster or other officers.
    SECTION X: SERVICE OFFICER: Assist Marine veterans and veterans of all U.S. Military services upon request and their dependents, widows or widowers in securing the benefits provide by the law and regulations. The Detachment Service Officer must have been certified by an agency recognized to do so, such as the DAV. He must become acquainted with the Federal Laws and with their interpretations and applications, and with the regulations and interpretations of Federal regulations of Government agencies and other institutions within the framework of service to veterans.
    SECTION XI: QUARTERMASTER: Shall manage the “Ships Store”, providing assistance to members in obtaining uniforms and uniform items of the Marine Corps League. Expenses involved with ordering and limited stockage of regalia shall be submitted with receipts to the paymaster. Funds collected in excess of expenses may be retained for up to 30 days. Sales may be marked up fifteen percent (15%) to recoup shipping and handling costs.
    SECTION XII: HISTORIAN: Shall document photographically all Marine Corps League activities of the Detachment and input photographical materials to individuals, committees and the Detachment. The Historian also maintains the Detachment photo albums.
    SECTION XIII: WEB SERGEANT: Shall maintain the Detachment website (currently mcl1199.org). Expenses incurred such as web fees shall be submitted to the chairperson of the finance committee for approval. Expenses shall be submitted on the FUNDS REQUEST FORM with receipts.

    SECTION XIV: CHAIRPERSON OF COMMITTEES: Within the Detachment there are two (2) types of committees, Standing and Special. All committee reports shall be made on the floor by the Chairperson. The committee chairperson shall recommend to the Commandant the names of persons he desires for membership on his committee. The Commandant, at his discretion, may appoint such members. The Chairperson of all Committees will be responsible for the all Committees funds and shall be bonded. Committee Chairpersons, when relieved of their duties shall turn over to their appointed successors all property and funds in their possession.
    STANDING COMMITTEES: Designated Detachment members, either elected or appointed, may be assigned additional duties as Committee Chairpersons:
    1. finance Committee (all the elected Officers) - Senior Vice Commandant

    2. Professional Development Program Coordinator - Senior Vice Commandant

    3. Membership Committee - Junior Vice Commandant

    4. Awards Committee - Adjutant

    5. House Committee - Sergeant at Arms    

      SPECIAL COMMITTEES: The Commandant shall appoint by letter the Chairperson of all Special Committees.

    3. Social and Recreation

    4. Toys for Tots

    5. Convention

    6. Marine Rose Program

    7. Quartermaster (Ships Store)

    8. As required by regulation or circumstance   

    SECTION XV: All officers, elected or appointed and all committee chairpersons shall turn over all Marine Corps League property to their successors within fourteen (14) days of leaving office. In addition all members having League property shall maintain a written inventory, subject to inspection quarterly.
    SECTION XVI: An officer of this Detachment who has missed three (3) consecutive meetings, either general or special, without an acceptable excuse to the “Board of Trustees” shall be deemed to have shown a lack of proper interest in the welfare of the Detachment and in his office. His office shall be then declared vacant and the Commandant may fill the vacancies with the approval of the Board of Trustees.
    SECTION XVII: No member shall write any article to newspapers, script for radio or other news outlets concerning the Marine Corps League without first being cleared by the detachment or the Commandant.
    SECTION XVIII: All members are required to inform the Adjutant or any officer of any change of address, email address or telephone number as quickly as possible.
    SECTION XIX: DISCIPLINE OF A DETACHMENT MEMBER OR MEMBER OF THE BOARD OF TRUSTEES.

    Whenever an individual member or Detachment Officer commits an act contrary to the National Bylaws and Administrative Procedure of the Marine Corps League or an act which is deemed not in the best interest of the Marine Corps League, he shall be referred to the Detachment Judge Advocate for appropriate action.

    SECTION XX: BYLAWS: Changes or Amendments to these Bylaws shall be read and approved at the regular meeting after they have been approved and passed but the Board of Trustees. The Amended Bylaws shall be sent to the Department Judge Advocate for final approval. Notice of proposed changes and amendments to these Bylaws must be made to all members in time for them to appear at the meetings.

    SECTION XXI: No member shall write any letter to Department or National Headquarters without first getting the letter approved on the floor. All such communications shall be forwarded via official channels. No member shall be denied the right to forward such communications, if within good taste: however, the Detachment may add a written disapproval.

    SECTION XXII: All donations to the Detachment shall be placed in the General Fund. Donations made to a specific activity of the Detachment shall be placed in the Ancillary Fund. All Funds received by a special committee shall be accounted for by the Committee Chairperson. The Committee Chairperson shall report the status of Committee funds at the regular membership meetings. 

    SECTION XXIII: These Bylaws supersede all previous editions of the Pahrump Detachment No.1199 Bylaws and become effective upon approval. All previous editions will be destroyed.

He shall be assigned the duties as Chairperson of the Finance Committee and serve as the Professional Program Coordinator. Is an alternate signatory on the Detachment checking account. He shall prepare an annual budget for Community grants that is based on the previous fiscal year’s collections. He shall provide and publish to the membership guidelines for all grants and disbursements of the Finance Committee, no one activity may exceed ten percent (10%) of the annual budget and is subject to audit.

    SECTION III: JUNIOR VICE COMMANDANT: Shall preside in the absence of the Commandant and the Senior Vice Commandant, while so presiding shall have the power and authority of the Commandant. The Junior Vice Commandant shall preside as Chairman of the Finance Committee should the Senior Vice Commandant be absent and shall be the Chairperson of the Membership Committee of the detachment having the power to call upon Detachment members to assist in recruiting duties.

    SECTION IV: JUDGE ADVOCATE: Shall perform such legal duties as are assigned to him by the Commandant. He shall rule on any disputed point of order. He must be conversant with National, department and Detachment Bylaws. His opinions are binding but may be appealed.

    SECTION V: UNIOR PAST COMMANDANT: Shall serve on the Finance Committee and have organizational cognizance over all Standing Committees. May be assigned as publisher and editor of the monthly Newsletter.

    SECTION VI: ADJUTANT: The Adjutant shall keep proper minutes of all meetings of the Detachment. He shall keep the Detachment Roster of members up to date as changes are reported by members and perform all duties as assigned by the Commandant. He shall be the Chairman of the Awards Committee.

    SECTION VII: PAYMASTER: He shall keep all monies, other than the special funds which are under control of special or standing committees. He shall submit his financial records for audit by the Board of Trustees, semi-annually during April and October of each year. He shall be responsible to keep true and accurate records of all funds received and disbursed on behalf of the Detachment. Arrange for deposits of all monies in a bank designated by the board. Funds collected shall be deposited to the Detachment’s account as soon as possible but in no event longer than five (5) bank business days.

    Pay all legitimate bills and debts for the normal upkeep and maintenance of the Detachment. Disbursements shall be made by check or debit card, the debit card may only be used personally by the Paymaster and only when a check is inappropriate as authorized herein. The Paymaster is authorized to send up to three hundred dollars ($300.00) without prior approval but must justify the expenditure to the board at the next meeting. Make monthly reports to the Detachment Membership on the financial position of the Detachment subject to audit. Provide reports, projections and financial recommendations to the board as required. Act as the liaison with the Department of Nevada and National as concerns membership and dues. He will submit any financial reports they require. He shall also make financial reports to the State and Federal Government as required. Bonding is automatically provided by the Marine Corps League. Be a signatory on the Detachment checking account. Make his books and records available at any time for a board authorized audit. At the conclusion of his term in office surrender all books, records, monies and any other property under the Paymaster’s charge to the newly appointed Paymaster (within 14 days max).

    SECTION VIII: CHAPLAIN: Shall perform such duties of a spiritual nature as customarily performed by members of the clergy within the guidelines of established Marine Corps League procedures. Assist members with sickness and condolence calls, correspondence with family members and their families. Advise the board and/or general membership of any Marine who are sick or distressed. Perform whatever rituals are required of his office at meetings, funerals and special functions as outlined in the Marine Corps League ritual handbook.

    SECTION IX: SERGEANT AT ARMS: Shall assist the Commandant in keeping order at all meetings. He shall act as Chairperson of the House Committee and see that all is in readiness for all meetings. He shall check the members present for eligibility and assure himself that only those entitled are admitted. He shall act as escort to all visitors and perform such duties as the Commandant may assign him. He shall be in charge of all Detachment property not in the possession of the Paymaster or other officers.

    SECTION X: SERVICE OFFICER: Assist Marine veterans and veterans of all U.S. Military services upon request and their dependents, widows or widowers in securing the benefits provide by the law and regulations. The Detachment Service Officer must have been certified by an agency recognized to do so, such as the DAV. He must become acquainted with the Federal Laws and with their interpretations and applications, and with the regulations and interpretations of Federal regulations of Government agencies and other institutions within the framework of service to veterans.

    SECTION XI: QUARTERMASTER: Shall manage the “Ships Store”, providing assistance to members in obtaining uniforms and uniform items of the Marine Corps League. Expenses involved with ordering and limited stockage of regalia shall be submitted with receipts to the paymaster. Funds collected in excess of expenses may be retained for up to 30 days. Sales may be marked up fifteen percent (15%) to recoup shipping and handling costs.

    SECTION II: HISTORIAN: Shall document photographically all Marine Corps League activities of the Detachment and input photographical materials to individuals, committees and the Detachment. The Historian also maintains the Detachment photo albums.

    SECTION XIII: WEB SERGEANT: Shall maintain the Detachment website (currently mcl1199.org).

    Expenses incurred such as web fees shall be submitted to the chairperson of the finance committee for approval. Expenses shall be submitted on the FUNDS REQUEST FORM with receipts.

    SECTION XIV: CHAIRPERSON OF COMMITTEES: Within the Detachment there are two (2) types of committees, Standing and Special. All committee reports shall be made on the floor by the Chairperson. The committee chairperson shall recommend to the Commandant the names of persons he desires for membership on his committee. The Commandant, at his discretion, may appoint such members. The Chairperson of all Committees will be responsible for the all Committees funds and shall be bonded. Committee Chairpersons, when relieved of their duties shall turn over to their appointed successors all property and funds in their possession.

    STANDING COMMITTEES: Designated Detachment members, either elected or appointed, may be assigned additional duties as Committee Chairpersons:

    1. finance Committee (all the elected Officers) - Senior Vice Commandant

    2. Professional Development Program Coordinator - Senior Vice Commandant

    3. Membership Committee - Junior Vice Commandant

    4. Awards Committee - Adjutant

    5. House Committee - Sergeant at Arms

    SPECIAL COMMITTEES: The Commandant shall appoint by letter the Chairperson of all Special Committees.

    1. Bylaws

    2. Ancillary

    3. Social and Recreation

    4. Toys for Tots

    5. Convention

    6. Marine Rose Program

    7. Quartermaster (Ships Store)

    8. As required by regulation or circumstance

    SECTION XV: All officers, elected or appointed and all committee chairpersons shall turn over all Marine Corps League property to their successors within fourteen (14) days of leaving office. In addition all members having League property shall maintain a written inventory, subject to inspection quarterly

    SECTION XVI: An officer of this Detachment who has missed three (3) consecutive meetings, either general or special, without an acceptable excuse to the “Board of Trustees” shall be deemed to have shown a lack of proper interest in the welfare of the Detachment and in his office. His office shall be then declared vacant and the Commandant may fill the vacancies with the approval of the Board of Trustees.

    SECTION XVII: No member shall write any article to newspapers, script for radio or other news outlets concerning the Marine Corps League without first being cleared by the detachment or the Commandant.

    SECTION XVIII: All members are required to inform the Adjutant or any officer of any change of address, email address or telephone number as quickly as possible.

    SECTION XIX: DISCIPLINE OF A DETACHMENT MEMBER OR MEMBER OF THE BOARD OF TRUSTEES.

    Whenever an individual member or Detachment Officer commits an act contrary to the National Bylaws and Administrative Procedure of the Marine Corps League or an act which is deemed not in the best interest of the Marine Corps League, he shall be referred to the Detachment Judge Advocate for appropriate action.

    SECTION XX: BYLAWS: Changes or Amendments to these Bylaws shall be read and approved at the regular meeting after they have been approved and passed but the Board of Trustees. The Amended Bylaws shall be sent to the Department Judge Advocate for final approval. Notice of proposed changes and amendments to these Bylaws must be made to all members in time for them to appear at the meetings.

    SECTION XXI: No member shall write any letter to Department or National Headquarters without first getting the letter approved on the floor. All such communications shall be forwarded via official channels. No member shall be denied the right to forward such communications, if within good taste: however, the Detachment may add a written disapproval.

    SECTION XXII: All donations to the Detachment shall be placed in the General Fund. Donations made to a specific activity of the Detachment shall be placed in the Ancillary Fund. All Funds received by a special committee shall be accounted for by the Committee Chairperson. The Committee Chairperson shall report the status of Committee funds at the regular membership meetings.

    SECTION XXIII: These Bylaws supersede all previous editions of the Pahrump Detachment No.1199 Bylaws and become effective upon approval. All previous editions will be destroyed.

    APPROVAL: The Detachment Bylaws were approved by a two-thirds vote of the general membership present at the general meeting on 13 August 2022.
